This notice describes how we collect and processes users’ data through Ontoolz mobile application (“Ontoolz”). The terms “we”, “us”, “our” refer to Company “Ontoolz LTD”, a legal person registered under the laws of the United Kingdom of Great Britain and Northern Ireland.

We are committed to safeguarding privacy of our users. We are not going to misuse your data.

There are two types of Ontoolz users: Employers and Tradesmen. Employers are the users that offer jobs through Ontoolz, and Tradesmen are those who apply for jobs from Employers. We refer to Employers and Tradesmen when specific data processing activities apply. In other cases, we generally refer to Employers and Tradesmen as to “users” or “you”.

Information We Collect from You

Account registration and profile set up

When first accessing the application, you will be able to register an account and fill in information about you. You will be able to register via Facebook/Google ID or manually by providing your email address and creating a password. We collect the following data points during the registration:

for those registered through Google/Facebook, we collect a unique ID assigned by the chosen provider. Regardless of the registration using Google or Facebook, we will also create your unique user ID. We also collect the hash value of the password to your account, in order to verify it when you log in. The user will also be requested to insert a temporary access code, which we will send him/her by SMS to confirm the possession of the device, for which the account is registered;
General account information: type of the user (tradesman/employer), type of the person (individual/company), first name, last name, trading name, company name, email address, profile photo, phone number;
Specific data points for Tradesmen: primary trade, secondary trade, primary trade experience, secondary trade experience, residence location, territory of preferred job locations, own transport (yes/no), own tools (yes/no), personal protective equipment (yes/no), Construction Skills Certification Scheme (CSCS) (yes/no), Construction Industry Scheme (CIS) (yes/no).

After the creation of the account, you will be able to fill in your profile information. This info will be publicly available to other users and will be used for the matchmaking between Employers and Tradesmen for further interactions. While any Tradesman will be able to access and review Employer’s profile, only those Employers that are connected with the user in question will be able to access his/her public profile. In a limited form, public profiles are also available to non-registered users of Ontoolz. The following information will form a user profile:

for Employers: we will show Employer account information, such as the type of the person (individual/company), first name, last name, trading name, company name, and profile photo. An Employer can also add «About me» description;
for Tradesmen: the profile will contain the account details, such as type of the person (individual/company), first name, last name, profile photo, primary trade, secondary trade, primary trade experience, secondary trade experience, residence location, own transport (yes/no), own tools (yes/no), personal protective equipment (yes/no), CSCS (yes/no), CIS (yes/no). A Tradesman can fill in their profile with additional points: «About me» description, requisites: National Insurance Number (NIN), Unique Taxpayer Reference number (UTR), CIS rate, Value-Added Tax (VAT) rate, VAT number; photos of previous works, description of previous works, and language spoken.

We use the account and profile information to:

create and maintain your user account, including securing the access to it by password and two-factor authentication features;
contact you regarding the work of Ontoolz and/or your account;
provide you with technical support;
upon receiving the consent from you, to send you marketing or promotional materials;
provide your profile publicly available to other users;
for Tradesmen, to match them with the job posts that suit their qualification and other characteristics;
generate invoices based on Tradesmen requisites.

We will store these categories for as long as you have the account with us and 365 days after you delete your account.

Job posts and responses

Employers can post an advertisement for a job to search for Tradesmen suitable for the job.

A job post will contain the following information: job type (commercial/private), type of contract (daywork/pricework), trade required, experience required, description of the job, start date, night shift (yes/no), payment type, deposit (yes/no), deposit period, work address, job-related photos, language required, CSCS, CIS, transport availability, tools required, personal protective equipment required, Employer’s first and last name, trading name, company name, Employer’s photo, phone number.

Based on a Tradesman profile and account information, we will inform him/her that a job post that might suit their characteristics is available. Whenever a Tradesman replies to the job post, the Tradesman’s profile data will be provided to the Employer for a review.

All job activities of Tradesmen and Employers are available at the Activities Dashboard page in the application. For Tradesmen, all activities will be grouped in the active jobs, applied jobs, closed jobs, and rejected jobs. For Employers, all activities will be grouped in open job requests, active jobs, and closed jobs.

The data about job posts and responses will be stored for as long as for other user account data.

Invoicing and payment processing

When the performance of Tradesman’s works arranged through Ontoolz is fully or partially done (as agreed between the users), the users can generate the invoice and proceed with the payment. For the invoice generation, we collect the following information:

invoice ID and subject (job done), invoicing period, working days, daywork rate in GBP, issue date, due date, invoice status (draft/sent/pending/paid/rejected);
jobs: description, quantity, unit price (GBP), subtotal price (quantity x unit price);
expenses: description, quantity, unit price (GBP), subtotal price (quantity x unit price);
invoice subtotal, amount due, invoice total in GBP.

Invoice information is then being forwarded to the third-party payment system, which will process the payment done between the Tradesman and the Employer. We forward invoice ID, issue date, invoice subtotal, amount due, and invoice total to the payment system. When conducting the payment, you will provide payment card data directly to the third-party provider. We do not have access to your payment card data.

The payment and invoice data will be stored for as long as for other user account data, and certain payment details will be stored to comply with our financial and accounting obligations. Please note, that we still may store such payment details for the financial compliance if you delete your account or request the erasure of your data.

User reviews

The users that were engaged in job activities with each other may leave the reviews on the other user’s profile. Such reviews will be publicly available to other users along with other profile data. The following categories will be shown:

We also count a percentage of positive reviews for each user based on the overall number of reviews left by Tradesmen/Employers. All user reviews will be stored for as long as for other user account data.

Your connections

Our application allows building your social network with other Tradesmen and Employers you got engaged through Ontoolz previously. For this purpose, we will store and show you the list of your connections with other Ontoolz users, which you will be able to access and initiate further interactions. The other registered users that you previously interacted with will see the connection with you in their account.

You will also be able to invite new users to Ontoolz. For this purpose, our system will automatically generate a personal invitation link for you, which you can share with other people for joining Ontoolz. Your list of connections will be stored for as long as for other user account data.

Communications with other users

You can write and send messages to other Ontoolz users. We process and transmit those messages to the intended user. We further store the messages along with your account info for you to be able to review them and, where necessary, for us to access them and provide you with technical support.

All communications remain between you and the users you communicate with, and we will not access it without your request or strict necessity.

We store your communications data for as long as we do for the user account/profile information.

Traffic data

As we are continuously testing the application, certain traffic from our mobile application is collected automatically. The data categories we receive include the model of the device, operating system version, country of geolocation, user ID, date, time, and duration of the user session, pages viewed, buttons clicked, payment amount, error code, and error message.

We use this information to enable and improve the app work and analyse traffic statistics in the app for improvement purposes. Learn more about it in the section “Analytics” of this notice.

We will store the collected information for 6 months after your last user session.

Communications with us

Occasionally, we collect user feedback and provide technical support if you have any inquiries regarding the work of our application. We use this information to provide you with the help you might need, fix and improve our services, and analyse our efficiency in marketing and product efforts, including by creating statistics of inquiries.

We will store the collected information for our legitimate interests and further analysis for 365 days after the last communication with you. If we need to further use this information, we will fully anonymise it first.

Legal Basis for Processing

Performance of Contract

We process your account and profile data, interactions with other users, requests for technical support, job posts and activities, communications, invoices and payments, connections with other users, and log information to provide you with the app services. Without this information, we will be unable to provide you with the application functionality as the work of our marketplace strongly depends on the user data.

Your Consent

For the e-mails with our newsletters, announcements, and other offers (marketing emails), we will obtain the consent from you, which serves as a legal base for the processing of your information. User reviews are also published by you based solely on your discretion/consent.

You can withdraw your consent at any time by contacting us directly. The withdrawal will not affect the lawfulness of processing based on consent before. You can also opt-out from the e-mail subscription by clicking the appropriate button in our e-mails to you.

Legitimate Interests

For improving our application and marketing activities, we process statistics of your activity and your requests for support. To strengthen the security of your account, we also enable a two-factor authentication of the account access in our legitimate interests. We can also send you occasional emails with our updates or new products/services, and other emails for the information purpose.

You can opt-out of email subscription by clicking the appropriate button in our emails to you.

Legal Compliance

As stated above, we will need to process invoice and payment data for our accountability and financial compliance purpose. Thus, the legal ground for the processing will be compliance with our legal obligations.

Third-party Access to Information

Third-party service providers

The following categories of third-party providers are used to enable the work of Ontoolz application:

Registration using the account on third-party platforms;
Traffic analytics;
Payment processing system;
Internal chat communication feature;
Two-factor authentication provider;
Cloud storage provider.

Please note, that such third-party providers can only process your data on our behalf and do not use it for their own purposes.

Other Disclosures

In addition to the disclosures for the purposes identified before, we may disclose information about you:

if we are required to do so by law, in connection with any legal proceedings or to establish, exercise or defend our legal rights; and
in case we sell, license or otherwise assign our company, corporate rights, Ontoolz or its separate parts or features to third parties.

Except as provided in this privacy notice, we will not sell, share or rent your information to third parties.

Your Rights

To control our data protection activities, you may exercise certain rights regarding your information. In particular, you have the right to:

Object to the processing of your information. If we process your information in our legitimate interests, e.g., for direct marketing emails or for our marketing research purposes, you can object against it. We will consider your request and, if there are no compelling interests to refuse it, stop the processing for such purposes;
Access your information. You have the right to know if we process your information; obtain disclosure regarding certain aspects of the processing; and obtain a copy of the information undergoing processing.
Verify your information and seek its rectification. If you find that we process inaccurate or out-of-date information, you can verify the accuracy of your information and/or ask for it to be updated or corrected;
Restrict the processing of your information. When you contest the accuracy of your information, believe we process it unlawfully or want to object against the processing, you have the right to temporarily stop the processing of your information to check if the processing was consistent. In this case, we will not process the information for any purpose other than storing it until the circumstances of restriction cease to exist;
Ask us to delete/destroy/otherwise remove your information. If we are not obliged to keep the data for legal compliance, we will remove your information upon your request; and
Ask us to transfer your information to another organisation if we process the information based on your consent or on the necessity to perform the contract.

If you believe that our use of personal information violates your rights, you can lodge a complaint with the competent data protection authority.

Security of Information

We take necessary and sufficient measures to protect your information from unauthorised or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions of third parties. As we have employees across several countries outside of the European Union, we may transfer the collected data to those countries for further processing. In such cases, we will make sure that relevant safeguards are in place, such as Standard Contractual Clauses.

Immediate access to the data is only allowed to our authorised employees involved in maintaining the application. Such employees keep strict confidentiality and prevent unauthorised third-party access to personal information.

Changes to This Notice

We may update this privacy notice from time-to-time by posting a new version on our website. We advise you to check this page occasionally to ensure you are happy with any changes. However, we will endeavour to provide you with an announcement about any significant changes.
